This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Word Hurdle - Word Game ("us," "we," or "our") governing the use of the Word Hurdle mobile application ("App").
Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.
The App and all rights, title, and interest therein, including but not limited to intellectual property rights, are and shall remain our exclusive property. This Agreement does not convey any proprietary interest in or to the App.
By using the App, you may submit content, such as scores or comments. You grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of operating and improving the App.
Word Hurdle offers monthly and annual subscription options. Our “Monthly” subscription is paid in monthly instalments. For each month that your monthly subscription is active, you acknowledge and agree that Word Hurdle is authorized to charge the same credit card or other payment method (the “Payment Method”) as was used for the initial subscription fee in the amount of the then current monthly subscription fee. The monthly renewal subscription fees will continue to be billed to the Payment Method you provided, automatically until cancelled. You must cancel your subscription before it renews each month in order to avoid billing of the next month's subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial-month subscription period. You may discontinue auto-renewals of your subscription at any time by going to phone settings -> Account -> Subscriptions. Our “Yearly” subscription is paid in yearly instalments. For each year that your yearly subscription is active, you acknowledge and agree that Word Hurdle is authorized to charge the same credit card or other payment method (the “Payment Method”) as was used for the initial subscription fee in the amount of the then current yearly subscription fee. The yearly renewal subscription fees will continue to be billed to the Payment Method you provided, automatically until cancelled. You must cancel your subscription before it renews each year in order to avoid billing of the next year’s subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial-year subscription period. You may discontinue auto-renewals of your subscription at any time by going to phone settings -> Account -> Subscriptions. You are responsible for all applicable fees and charges incurred, including applicable taxes, and all subscriptions purchased by you. Our obligation to provide service is only valid once we have received payment. You agree not to hold us responsible for banking charges incurred due to payments on your account. We may at any time, in our sole discretion, change the fees and charges, or add new fees and charges, in relation to the Program or any services offered through the Program. If you do not agree to the change, you may cancel your membership or subscription in your account settings.
We may provide updates to the App to enhance functionality, fix bugs, or add new features. We are not obligated to provide support, maintenance, or updates but may do so at our discretion.
The App is provided "as is," without warranty of any kind, express or implied. We do not warrant that the App will be error-free or uninterrupted.
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
We reserve the right to terminate this license at any time for any reason. Upon termination, you must cease all use of the App.
This Agreement is governed by and construed in accordance with the laws of Manitoba Canada, without regard to its conflict of law principles.
